Connecticut Search & Seizure Laws

Fighting Against Illegal Search and Seizure

The Fourth Amendment to the U.S. Constitution provides certain protections against invasion of privacy by the government. This includes preventing law enforcement agencies from searching your person, car or home without probable cause. If your Fourth Amendment rights have been violated and you are facing criminal charges as a result of an illegal search or seizure, it is critical to have an experienced attorney on your side.

The Law Offices of Mark M. Kratter, LLC, in Norwalk, Connecticut, serves criminal defense clients throughout Fairfield County including the communities of Norwalk, Stamford, Greenwich, Westport, Redding, Wilton, Ridgefield, Darien, Weston, Fairfield, Danbury, Stratford, Monroe, Newtown, Bethel, Danbury, New Canaan, Easton and Bridgeport.

At the law firm of Mark M. Kratter, LLC, in Norwalk, we represent clients throughout Fairfield County in a variety of criminal defense matters. Search and seizure law has undergone a number of changes recently, and important issues come into play in a large number of criminal cases. We have a comprehensive understanding of criminal law and we fight aggressively to see that your rights are protected.

Differences in Connecticut Search and Seizure Law

One of the major differences in Connecticut law involves the search of vehicles. If you are stopped by police, they are not allowed to search your vehicle without probable cause. Any evidence gathered in an illegal search is not admissible in court. If they tow your vehicle after your arrest, however, they are required to inventory everything in the vehicle. If they find anything illegal in your car during the inventory, it can be admissible in court.

With every case we take, our attorneys will work closely with you to learn as much as possible about the details of your arrest and find out exactly what happened. We will look at all of the police reports and any other evidence in the prosecution's case. We will file motions to suppress any evidence that was obtained illegally and do everything we can to beat the charges against you. If pretrial motions do not help, we can help you understand diversionary program options.
