No Fault Divorce in Connecticut
A dissolution of marriage will be granted in Connecticut on no-fault grounds if the court finds that one of the following causes has occurred:
- The marriage has broken down irretrievably
- The parties have lived apart continuously for at least 18 months due to incompatibility immediately prior to service of the divorce complaint and there is no reasonable prospect that they will reconcile
While the term irretrievably is not defined in statute, Black's Law Dictionary states that it is a ground for divorce that is "based upon incompatibility between marriage partners" and is used in many states, including Connecticut, as the sole ground of no-fault divorce. Incompatibility of personalities is not a ground for divorce in Connecticut, however, and married people are expected to accept the ordinary changes in a marriage that are caused by making an unwise choice of a mate. The determination of whether the breakdown of a marriage is irretrievable or not is a question of fact to be determined by the court.
