Connecticut law prohibits driving while under the influence of drugs or alcohol, or with an elevated blood alcohol content (BAC). The degree to which a driver is under the influence of alcohol or drugs is measured by a BAC test.
Blood Alcohol Content Tests
A police officer may measure a motorist's blood alcohol content in Connecticut by testing his blood, breath, or urine. The law establishes a presumption that the driver's BAC at the time is was taken is the same as the BAC at the time he was stopped, and requires two tests at least 10 minutes apart. If the result of the second test is .10 percent or less and higher than the first test, the prosecution is required to prove that the test results accurately represent the driver's BAC at the time of the alleged offense.
If a driver was not injured, the following criteria must typically be met in order for the test results to be admissible in court:
- The driver must have received a reasonable chance to call a lawyer before taking and consenting to the test.
- A copy of the test results must be mail or personally delivered to the driver within 24 hours or the end of the next business day.
- The test must be given by a police officer or at an officer's direction.
- Methods and equipment approved by the Department of Emergency Services and Public Protection (DESPP) must be used to administer the test
- The test equipment must have been checked for accuracy according to DESPP regulations.
- A second test of the same type must be administered at least 10 minutes after the first test.
- The test must have begun within two hours of the time of the alleged offense.
